At the motion hearing, for the first time, Defendants counsel represented that the Department of Homeland Security and Secretary Nielsen had relied on both section 102(a) and 102(b) of IIRIRA when issuing the waiver at issue in this case. Plaintiffs counsel responded by requesting an opportunity to file a supplemental brief.
