Titanic Memorial Act of 1986 and the international agreement between the United States, England, France and Canada. Court directs service to Mr. Leonard who can accept service on behalf of the United States and its agencies involved and Mr. Stillman can effect service on the Attorney General pursuant to the rules of the declaratory judgment action. Court granted plaintiffs' motion to merge the declaratory judgment (2:00cv237) into the in rem proceeding before this court. Once the parties are at issue and answers are filed before the court, counsel should contact the court to set it down for a hearing. ORDER that this Court maintains in rem jurisdiction over the wreck and wreck site of the RMS Titanic. The Court has received information, and based upon that information FINDS that pursuant to a posting of 9/14/06, EBAY member "dan585585" claims to have in his possession certain pieces of the hull of the RMS Titanic, which he obtained while shipping artifacts from the "twin cities" to "atlantic city new jersey." The Court further FINDS that as RMS Titanic, Inc. shipped artifacts from St. Paul, Minnesota to Atlantic City, New Jersey in 1999, and that "dan585585" claims that the artifacts in his possession are real pieces of the Titanic hull, there is REASONABLE CAUSE to believe that "dan585585" may be in possession of artifacts from the wreck of the RMS Titanic, and which artifacts may be under the jursidiction of this Court. Accordingly, this Court ORDERS that EBAY disclose to RMS Titanic, Inc. the full name, address, telephone number, and email address of "dan585585" and further ORDERS that EBAY take all steps necessary to prevent "dan585585" from attempting to sell any and all items which purport to be artifacts recovered from the wreck and wreck site of the RMS Titanic. STATUS HEARING proceedings held before Judge Rebecca Beach Smith: Robert W. McFarland, Brian A. Wainger, and David J. Bederman, appeared on behalf of plaintiff; Lawrence R. Leonard, AUSA, appeared on behalf of the United States. Status Hearing held on 10/1/2007. Matter came on for a status hearing. The court stated that the purpose of this hearing is (1) to receive an updated report from the United States regarding the status of legislation to implement an international agreement; and (2) for the court to set a timeline for R.M.S. Titanic to pursue a salvage award. For the reasons stated from the bench, the court ordered RMST to submit a motion for a salvage award, with supporting documentation, to this court within sixty days. This motion shall include all of RMST's salvage efforts until January 1, 2007. If RMST chooses not to submit its motion for salvage award, this court will consider that RMST has absorbed the costs of salvage and does not wish to pursue a salvage award. The court further entrusts the United States, through the United States Attorney's Office, to review RMST's actions and any salvage award which it chooses to submit. The court will issue an order.
