Defendant sentenced to 18 months, that he thereafter serve a term of supervised release of 3 years, and that he pay the mandatory special assessment of $100. It is further adjudged that he forfeit to the United States the sum of $1,228,660.93, as more fully set forth in the order of forfeiture signed 7/21/16 on terms to be determined on October 5, 2016 at 3:00pm. The following special conditions of supervision apply: 1) The defendant shall provide the probation officer with any financial information he or she may request; 2) The defendant shall not incur new credit charges or open additional lines of credit without the approval of the probation officer; 3) The defendant shall report to the nearest probation office within 72 hours after he is released from custody. The mandatory drug testing condition is suspended because the Court finds a low risk of substance abuse. On motion of the Government, the Court granted the application for voluntary surrender. The defendant is continued on bail subject to the direction that he surrender to the Bureau of Prisons on the date, by the time, and at the place designated by it for the service of his sentence. The Court orders that he surrender on the date, by the time, and at that place. JUDGMENT In A Criminal Case. Date of Imposition of Judgment: July 21, 2016. Defendant Trendon T. Shavers (1) pleaded guilty to Count(s) 1. Count(s) 2 is dismissed on the motion of the United States. IMPRISONMENT: 18 Months. The defendant shall surrender to the Bureau of Prisons on the date, and by the time, and at the place designated by it for the service of his sentence. If for any reason the defendant hasn't surrendered to the BOP by 9/13/2016, he shall surrender to the U.S. Marshal for the Southern District of New York on the 4th floor of this building before 2:00pm on that date. -The court makes the following recommendations to the Bureau of Prisons: That consistent with the defendant's security classification, he be designated to FCI Seagoville. SUPERVISED RELEASE: 3 Years. -The above drug testing condition (see page 3 of judgment) is suspended, based on the court's determination that the defendant poses a low risk of future substance abuse. -The defendant shall not possess a firearm, ammunition, destructive device, or any other dangerous weapon. -The defendant shall cooperate in the collection of DNA as directed by the probation officer. Special Conditions of Supervision (see page 4 of judgment). ASSESSMENT: $100, due immediately. The determination of restitution is deferred until 10/5/2016. JUDGMENT IN A CRIMINAL CASE (Correction of Sentence for Clerical Mistake) as to Trendon T. Shavers (1), Pleaded guilty to Count(s) 1. Imprisonment: 18 Months. Supervised Release: 3 Years. Count(s) 2, Dismissed. The defendant shall surrender to the Bureau of Prisons on the date, and by the time, and at the place designated by it for the service of his sentence. If for any reason the defendant hasn't surrendered to the BOP by 9/13/16 he shall surrender to the U.S. Marshal for the Southern District of New York on the 4th floor of this building before 2:00pm on that date. ORDER OF RESTITUTION as to (15-Cr-157-1) Trendon T. Shavers. Upon the application of the United States of America, by its attorney, Preet Bharara, United States Attorney for the Southern District of New York, Daniel S. Goldman and Michael Ferrara, Assistant United States Attorneys, of counsel; the presentence report; defendant Trendon T. Shavers' conviction on Count One of the above-referenced Indictment (the "Indictment"); and by Order of the Court at Shavers' July 21, 2016 sentencing; and all other proceedings in this case, it is hereby ORDERED: 1. Amount of Restitution. Shavers shall pay restitution in the total amount of $910,636.16 to the victims of the offenses charged in Count One of the Indictment. The names and addresses of the victims are set forth in the Schedule of Victims attached hereto. Upon advice of a victim's change of address, the Clerk of the Court is authorized to send payments to the new address without further order of the Court. 2. Payment Schedule. Shavers shall make restitution to victims payable to the Clerk of Court, United States District Court. Restitution shall be paid at the rate of 10% of Shavers' gross monthly income. 3. Change of Address. Shavers shall notify the U.S. Attorney for this district within 30 days of any change of mailing or residence address that occurs while any portion of the restitution remains unpaid. 4. Sealing. Consistent with 18 U.S.C. §§ 377l (a)(8) and 3664(d)(4), and Federal Rule of Criminal Procedure 49.1, to protect the privacy interests of victims, the Schedule of Victims attached hereto shall be filed under seal, except that copies may be retained and used or disclosed by the Government, the Clerk's Office, and the U.S. Probation Department, as need be to effect and enforce this Order, without further order of the Court.
