The trial justice disagreed and concluded that granting retroactive relief would be contrary to the mandate in Andrews II, which stated: \"The case shall be remanded to the Superior Court with instructions to enter judgment consistent with the 'specific provisions pertaining to the Medicare Ordinance' as set forth in the Final and Consent Judgment entered in PC 11-5853 and PC 12-3590 on April 12, 2013.\" The Supreme Court agreed with the trial justice that the mandate in Andrews II required the Superior Court to enter judgment and did not contemplate evidentiary proceedings. Therefore, the Supreme Court affirmed the judgment of the Superior Court."},{"absolute_url":"/opinion/2977150/in-re-hnrc-dissolution-co-v/","attorney":"","caseName":"In re: HNRC Dissolution Co. v.","caseNameFull":"","citation":[],"citeCount":0,"cluster_id":2977150,"court":"Bankruptcy Appellate Panel of the Sixth Circuit","court_citation_string":"6th Cir.
